Q1.   What is Labour Audit? श्रम अडिट के हो?

  1. Labour Audit is a legal compliance-checking tool relating to employment practices and policies of an employer. It is an important exercise to scrutinize minutely the adherence of employer and employees to the prevalent labour laws of the country.श्रम अडिट रोजगारदाताका रोजगारीसँग सम्बन्धित नीतिनियम र अभ्यासहरू कानूनसम्मत छन् वा छैनन् भनी जाँच्‍ने एउटा कानूनी साधन हो। यो एउटा महत्चपूर्ण अभ्यास हो जसमा मुलुकको श्रम सम्बन्धी कानूनलाई रोजगारदाता र श्रमिकले कसरी पालन गरिरहेका छन्  भनेर मिहीन तरिकाले हेरिन्छ।

 

Q2.   Is Labour Audit mandatory provision? के श्रम अडिट बाध्यकारी ब्यवस्था हो?

  1. Yes. Pursuant to Section 100 of the Labour Act 2074 (2017) and Rule 56 of the Labour Regulation, 2075(2018), Labour Audit is a mandatory legal provision of the law to be followed by all employers.

          हो।  श्रम ऐन, २०७४ को दफा १०० एवम् श्रम नियमावली, २०७५ को नियम ५६ बमोजिम, श्रम अडिट हरेक रोजगारदाताले पालन गर्नैपर्ने एक बाध्यकारी कानूनी ब्यवस्था हो ।

 

Q3.    Where is Labour Audit applicable? श्रम अडिट कसले गराउनुपर्दछ?

  1. All local, national, native, foreign, multinational and international organisations, institutions, companies, firms, entity that are profit making or not for operating in Nepal (defined as an ‘enterprise’ the by Labour Act) and have hired employees for their operations are liable to have labour audit. Where there is employer and employee relation, unless they are governed by any other laws of Nepal relating to employees, the labour Act prevails and the labour audit becomes mandatory for them.नेपालमा सञ्चालित नाफा कमाउने वा गैरनाफामूलक स्थानीय, राष्ट्रिय, स्वदेशी,  विदेशी, बहुराष्ट्रिय र अन्तर्राष्ट्रिय सबै संघ, संस्था, कम्पनी, फर्म, निकाय जसले आफ्नो कार्य सञ्चालनका लागि कर्मचारी नियुक्त गर्दछन् (श्रम ऐन अनुसार प्रतिष्ठानको परिभाषामा परेका) ति सबैले श्रम अडिट गराउनुपर्दछ। जहाँ रोजगारदाता र कर्मचारीको सम्बन्ध छ त्यहाँ अन्य कुनै नेपाल कानून लागु हुने भएमा बाहेक श्रम ऐन लागु हुन्छ र त्यहाँ श्रम अडिट बाध्यकारी ब्यवस्था हुन जान्छ।

 

Q4.   What are the objectives of Labour Audit? श्रम अडिटको उद्देश्य के हो?

  1. The main objectives of the Labour Audit is to support in increasing timely production and productivity by maintaining good industrial relation through assurance of labour rights and effective implementation of  the prevailing laws in the workplace. In addition to this, other objectives are as following:
  2. a) To increase the standard on adherence to the policies and legal provision relating to labour.
  3. b) To increase the oneness of labours by reducing their complaints.
  4. c) To reduce the load of the government in monitoring, regulation and inspection.
  5. d) To make institutions responsible and accountable themselves to implement policy and legal provisions.

 

कार्यस्थलमा विद्यमान कानूनी व्यवस्थाको प्रभावकारी कार्यान्वयन गरी असल औद्योगिक सम्बन्ध कायम राखी श्रमिकको हकहित सुनिश्चित गराएर समग्रमा उत्पादन र उत्पादकत्व अभिवृद्धिमा सघाउ पुर्‌याउनु नै श्रम अडिटको मूख्य उद्देश्य हो । यसका साथै श्रम अडिटका अन्य उद्देश्यहरु निम्न बमोजिम छन्-

(क) श्रम सम्बन्धी नीतिगत एवम् कानूनी व्यवस्थाको परिपालनाको स्तर बढाउने,

(ख) श्रमिकहरुको गुनासो कम गराई प्रतिष्ठान प्रति उनीहरूको अपनत्व बढाउने,

(ग) सरकारको अनुगमन, नियमन र निरीक्षणको भार कम गर्ने,

(घ) प्रतिष्ठान स्वयंलाई नीतिगत एवम् कानूनी व्यवस्था कार्यान्वयन गराउन जिम्मेवार र जवाफदेही बनाउने ।
